BERKELEY — A customer spotted a man with a handgun in his back pocket at a downtown restaurant and contacted officers who detained and arrested him, police said Tuesday.
Ernest Ochoa-Tavares, 26, of Oakland, was in line at a restaurant in the 2100 block of Shattuck Avenue on Saturday when the citizen spotted him with the gun, police said. Police arrested him on suspicion of carrying a loaded firearm in public and carrying a concealed firearm.
Both of the crimes are misdemeanors.
The citizen who called police reported neck and hand tattoos on Ochoa-Tavares and provided the description of his clothes, police said.
When two officers and a supervisor showed up minutes later, they saw Ochoa-Tavares standing inside the business at the counter. He matched the description given to police, and officers detained him in handcuffs without incident.
Once Ochoa-Tavares was in handcuffs, the officers saw a loaded, semi-automatic 9 mm handgun in his back pocket and arrested him, police said.
He was booked into the city jail.
